1. Acceptance of Terms

By accessing or using Merch Go ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users, including merchants, customers, and visitors.

2. Description of Service

Merch Go provides a merchant operating system that enables businesses to manage inventory, process payments, operate online storefronts, handle delivery logistics, run marketing campaigns (email and SMS), and manage customer relationships.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Merchant Responsibilities

Merchants using the Platform are responsible for:

  • Compliance with all applicable laws and regulations
  • Accuracy of product listings, pricing, and descriptions
  • Fulfillment of orders placed through their storefront
  • Proper handling of customer data in accordance with privacy laws
  • Compliance with SMS/TCPA regulations when sending text message campaigns
  • Maintaining valid payment processing credentials
  • Compliance with tax collection and reporting obligations

5. SMS Messaging Terms

By opting in to receive text messages, you agree to the following:

  • You consent to receive recurring automated marketing and informational text messages from merchants on the Merch Go platform
  • Consent is not a condition of purchase
  • Message and data rates may apply
  • Message frequency varies by merchant
  • You can opt out at any time by replying STOP
  • Reply HELP for assistance
  • Supported carriers include all major U.S. carriers

6. Payment Processing

Payments are processed through third-party payment processors (Stripe, PayPal, CardConnect, Arise). Merch Go does not store credit card numbers. All payment processing is subject to the terms of the respective payment processor.

7. Prohibited Activities

  • Sell illegal or prohibited goods or services
  • Engage in fraudulent transactions or deceptive business practices
  • Violate intellectual property rights
  • Send unsolicited SMS messages to individuals who have not opted in
  • Distribute malware or interfere with Platform operations
  • Collect user data without consent

8. Intellectual Property

The Platform, including its code, design, and branding, is the property of Merch Go. Merchants retain ownership of their content, products, and brand assets uploaded to the Platform.

9. Limitation of Liability

The Platform is provided "as is" without warranty of any kind. Merch Go shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Platform.

10. Termination

We may suspend or terminate your account for violation of these terms. You may close your account at any time. Upon termination, your data may be retained as described in our Privacy Policy.

11. Changes to Terms

We may update these terms periodically. Continued use of the Platform after changes constitutes acceptance of the updated terms.
